• Tenant not releasing house

Dear Sir,

My father one house in Jorhat, but tenant not release hose and tenant ask for money for release house, kindly help sir how to handle this issue.

Additionally you can immediately file a suit for eviction in the court.

If possible you may approach the police to say that when you ask him to vacate the house, he is threatening you. Though police usually do not interfere but you may take a chance.

Send a notice for eviction,

If the notice does not helps, file a suit for eviction under the Rent Control Act.

Firstly you see whether your house falls under the Assam Urban Areas Rent Control Act, 1972 or not. If yes then file eviction suit in Small Cause Court, Guwahati.

Secondly if your rented your house on contract basis and period of contract has lapsed then also file eviction suit, no notice is necessary. You do not required to pay any money to the tenant but demand rent not paid.

Please do not give any money to the tenant.

Break in the house and remove his belongings after lodging a complaint to the police station.

there is no need to give money to that person. Rather if he has not paid the rent then send him the notice for releasing the arrears of rent.

They cannot blackmail you to extort money from you.

In any case, they are trespassers over your house and hence, you can report this matter to the Police and get a FIR lodged against these people.

Dear Pritam, why would you pay money to the tenant? If your landlord has left his bed in the house then he must have locked the house which means he has not given up the possession 0f rented house then file eviction suit.
