Cidco transfer problem & dealing with cidco

I Mrs L, own a flat in Vashi. I am in the process of selling my flat to Mr. M. At the time of my buying the flat in the year 2003, I was not told about the requirement for a Cidco NOC and the payment of CIDCO transfer fees, and so I had not paid it. I bought the flat from my sister Mrs. S, and all the formalities of registration and stamp duty were completed. Since then I have been the owner of the flat. Mr M has applied for a loan from a bank, and one of the requirements of the bank is an NOC from CIDCO for the sale. It was at this time I got to know that I have to pay a CIDCO transfer fee, with retrospective effect. I was told by CIDCO officer V that I have to pay the fee and I am ready to do that. Now let me give you a bit of history regarding this flat. I have documentation for all that I am going to say below. 1. When the society decided to construct the building, a Mr. T was the member of the society. Before the construction began, he resigned from the membership of the society citing financial constraints. 2. His resignation was accepted by the society and he was refunded whatever money he had paid towards construction by the Society. 3. Subsequently the membership was offered to my sister Mrs. S, who accepted it. 4. Now, after Mrs. S was accepted as the member of the Society, she should have been issued a fresh share certificate with her name on it. The Society erred by not doing so and added her name at the back of the share certificate. 5. This makes it look like Mrs. S has bought the flat from Mr. T, when in reality that is not the case. 6. The Society has issued a letter too admitting that this mistake has been made. Now when my file has reached Mr. V the officer in CIDCO, he insists that a transfer fee has to be paid by Mrs. S also. Now my questions are as follows: 1. When there was no sale transaction between Mr. T and Mrs. S, why should she pay any transfer fees. 2. Secondly when I bought the flat from Mrs. S (in 2003) and went to register the sale at the registrar’s office, why was I not told that I should be paying a CIDCO transfer fee? How can CIDCO arbitrarily slap on these fees with retrospective effect, applying today's rates? Please advise!
