Pending Rent of 11 years in Mumbai due court case of Land Owners
Hello Sir,
I stay in South Mumbai, nearby girgaon, we are tenant since last 3 generation, our Land Lord (LL) has not taken Rent from last 11 years as due to his case is going on in court regarding ownership of land against his own brother.
We are 8 tenant residing in that premises. All tenant face same problem of pending rent from last 11 year. This premises is still in "Pagadi System". And as we are 3rd Generation residing there, No one has title cleared rooms in that premises, as all the room was in name of Late Parents or Grand Parents of current resident.
Now our Building was old around 70 to 80 years, required some repairs and re-development, BMC also has given notice to evacuate premises saying "Dhokadayak Imarat" (Dangerous to Stay). We all tenants have talked about this with Landlord but he is not taking any action to repair or for re-development also.
But most importantly, the problem is we have 11 years of pending rent which he is not accepting and giving excuse of Court Case.
So I want to ask you :-
1. can we tenant pay the rent directly to court ? and what is the procedure ?
2. And as our building is very dangerous to stay then can we take any legal action against the LL for not doing any repairs or re-development. ? Means if any one resident at premises will get hurt in event of fall of building or part of it then can we take any serious legal action against him ?
