Eviction and rent suit
I rented my office to a lady (her husband is a Junior lawyer) on 11 month and 29 days rent agreement, she paid the rent for 8 months and then stopped paying rent and 15 days before the expiry of rent agreement tenant filed a law suit seeking for long term rent with every thing in the pleading to be false even signature on the law suit was not of the plaint but handwriting of her husband. Interim injunction was ordered in favor of tenant. We appealed the order in District court but due to long leave of the Judge proceedings of appeal are pending. We are also fighting against suit in the junior court (termination of suit under order 7 rule 11 of CPC, 138 NI of dishonor of rent cheques and IPC 191,193,196 read along with Cr. PC.340.
Now my question is that we did not received rent since last 8 months and we want to file a suit for eviction and rent (about 85000) as per our agreement, but our lawyer is saying that a stamp duty (court fee) of Rs. 75000/- is to be paid (in Gujarat) is this logical
?or our stamp should be of about Rs 300/-
Please suggest.
