Land deal between two persons
One brother who is doctor having money asks elder brother to buy property. In an govt land aution the elder brother attends and buys a plot worth 25lakhs. Doctor brother pays down payment amount 12.5lakhs for buying the land and asks elder brother to bear another 12.5lakh buy taking loan. Elder brother takes loan and registers the property in his name by paying 1.7lakhs stamp duty. For next 7 years he is paying monthly emi worth ₹13, 473. Then their fathers gives each one of them ₹10lakhs from his property share. Then doctor brother wants to pay this ₹10lakhs to elder brother to close the loan. Then loan closed. Total emi amount paid by elder brother is ₹10.26lakhs. After 10 years from land bought now doctor brother wants plot is to be registered in his name by paying his elder brother ₹10.26 lakh with interest for four years. Now the land value is ₹70-80 lakhs. Is it legally fair? Here the doctor brother cheating elder brother. And above all he wants gift deed is to be done. Please suggest fair solution.
