Legal Advice on Ancestral Property Inheritance
Dear Lawyer,
I hope you are doing well. I need legal guidance regarding an inheritance issue in my family.
My grandmother passed away without a will, and my mother predeceased her. The property in question is ancestral land belonged to my grandmother’s mom which my grandmother built a house, and my two uncles (my mother’s brothers) have taken full ownership, denying me and my siblings any share.
I understand that under Muslim Personal Law, grandchildren do not automatically inherit if their parent predeceased the grandparent. However, since this is ancestral property and family practice ancestral property customs, I would like to know:
1. Do I have a legal right to claim my mother’s share in the ancestral property?
2. Are there any court rulings where grandchildren have successfully claimed inheritance in similar situations?
3. Can I file a partition suit to demand my rightful share?
4. What legal strategy would you recommend to strengthen my claim?
I appreciate your time and legal expertise on this matter. Please let me know how we can proceed.
Best regards,
Faiz
