Non Compete
Hi - I have worked as a consultant with an organization for 3 years.
During these years, I signed a consulting agreement (registered stamped agreement) with them which had a non-compete clause that post my assignment termination with them for 12 months I can't work with a competitor or else I would lose my ESOPs - till here it was fine.
After 3 years, they moved me to payroll and changed this clause to 18 months (instead of 12 months). I don't remember if I signed that agreement or not, but within a month of moving to employment (when I was on probation), I resigned & served them my notice period.
After my resignation, I moved to a non-compete organization and have worked there for 10 months and now I am moving to a competitor organization (post 12 months of disassociation with them, as I am not getting good opportunities in any other domain/industry).
Would the non-compete apply to me (since my agreed non-compete was 12 months, which later was changed to 18 months in the employment letter)?
