I am a resident of a row house in Borivali West, which was originally allotted by MHADA with a 10x30 feet plot size, without any additional storey. The house initially had a simple structure with a hall, kitchen, bathroom, and toilet. Over the years, some residents, including myself, have made renovations and upgrades, adding a second storey to their homes.
However, during these renovations, the original 9-inch common walls constructed by MHADA have been altered. Some of my neighbors have constructed 4-inch walls above the ground floor, which encroach into my space, reducing the interior width of my house from the original 10 feet to less than 9 feet. This encroachment has caused significant concern regarding the common wall and the impact on my property.
Could you kindly clarify if there are any specific rules or regulations regarding common walls in row houses, particularly in terms of renovations and encroachments into adjacent properties? Is there any legal recourse available for this issue?
