Leave encashment on Resignation

I Jahirulla Mahammad, joined the Repco Bank on [deleted] and relieved from the services of Repco Bank on account of resignation after serving 8 years. As on date of relieving of services of the bank, “my accumulated eligible earned leave balance was 122 days and requested the management to encash the same during full and final settlement. However, on continuous followup bank has encashed and released the amount to the extent of 61 days only instead 122 days (50%). On enquiry they replied orally as per the board approved policy of the bank 50 % of leave encashment was entitled for the employees whose service was less than the prescribed. (for other resigned employees 100% encashment eligible). In this connection I would like bring your kind attention that, “REPCO BANK being a Govt. of India Enterprise under the admirative control of Ministry of Home Affairs” and the Board of the Repco Bank constitute representatives of Central and State Goverments with the rank of “Indian Admirative Services” should not differentiate among the resigned employees based on the no of years of services during the settlement of eligible dues which is violation of the statutory rights as provided by the “Constitution of India” vide article 14A and 300A by drafting and approving a policy which is contrary to the constitution of India. Further, during the conversation with the management, I have presented various honourable high court/courts judgements where it is clearly mentioned that the “Leave encashment is akin to salary which is property and depriving a person of his property without valid statutory provision is violation of the provision of Constitution of India. If an employee has earned the Leave and employee has chosen to accumulate his earned leave to his credit then encashment becomes his Right and in absence of any statutory provision that right cannot be infringed by the organization” in-turn received a casual reply “Legal doors are open”. Knowing the fact by the management that, various judgments pronounced by the Honourable courts on the similar issues were available even though non releasing of earned leave encashment is depriving the rights of outgoing employee.
