Transfer of Property from Parent & Siblings using Relinquishment and Gift Deeds
Hi,
My parents jointly owned a residential property (flat) in Mumbai and one of the parents (mother) passed away intestate. Now my siblings i.e. an elder brother (married) and an elder sister (married) DO NOT wish to take/claim their respective inherited shares in the property (i.e. their inherited shares from the deceased mother). Further they also do not want any future inheritance (in the father's share) and want myself (i.e. their youngest sister) to get this entire property in future after their father (who also wants to act as per his children's wish)
Please guide what should be the appropriate way to legally transfer this property (i.e. after payment of appropriate Stamp Duty + Registration charges as applicable) so that it remains with a clear and marketable title (while ignoring any tax implications) i.e.:
1) We all the siblings (myself, elder brother, elder sister) execute relinquish deed for our inherited share (from the deceased mother) in favor of our father. Our father then can execute a gift deed for the entire property (i.e. his own original share + his inherited share from deceased wife + relinquished shares from his 3 children to him) in favor of their youngest daughter (i.e. myself)
OR
2) The other siblings (elder brother, elder sister) execute relinquish deed for their inherited share (from the deceased mother) in favor of their younger Sister (myself). Further my father will also execute a gift deed (only for his part share in the property) in favor of his youngest daughter (i.e. myself). This way the youngest daughter (myself) will receive the entire property (partly via Relinquishment deed and partly via Gift Deed). If so then which document will establish my total ownership of the property
OR
Any other appropriate way besides above 1) and 2)
