Fcam charges
We bought a flat in township with 24 building plan and 2000 total number of flats. Only 12 building (3 phases) are operational and rest are yet under construction phasewise. Phase 1 and 2 paid lifetime membership clubhouse charges while booking and 24 months maintenance with other charges. Sales person advised that if you take lifetime clubhouse membership you will not be charged anything for lifetime. During lockdown our original builder was not able to go ahead with construction so he sold the project to other big builder without consent of residents. Now new builder is saying you have to take handover of all STP, WTP and FCAM. As per project there are 5 total number of clubhouses. However only 2 are built till date that to they are not in good shape as builder is not maintaining properly.
Responsibility for Maintenance: The builder or developer is responsible for providing and maintaining essential services, including amenities, until the project is handed over to the homebuyers or the Residents Welfare Association (RWA) is formed. This is mandated under Section 11 (4)(g) of the RERA Act, 2016, which stipulates that all outgoings, including maintenance charges, are to be paid by the developer until possession is transferred. After paying lifetime clubhouse membership charges are we phase 1 & 2 members liable to pay maintenance of this clubhouses and Facilities for under construction project. NOTE: Builder has not done conveyance deed yet for individual building societies formed
