Doubt about Judge Act
I, K N Amarnath Rao (Respondent), hereby swear that, my Maintenance case is before the court of 1st Additional Civil Judge and JMFC Court at Bhadravati, Case No: C.Misc.No.1125/2021, the said case is being heard before the Bench of Hon’ble Judge Shri Ravikumar (In Charge). However, I have a suspicion that the judge's conduct is one-sided/unilaterally, those suspicions/allegations are as follows.
1) Supreme Court has ordered in the case of Rajnesh vs Neha and others, in Maintenance case both the parties should submit the assets and liabilities statement along with the bank statements of the previous 3 years to the court. However, in my case, the petitioner (Ashwini P) submitted only the Assets and Liabilities statement and failed to submit the 3-year bank statements to the court. They have misled the court and the said court, disrespecting the order of the Supreme Court, has made an interim order without properly examining the documents. The matter was brought to the attention of the Hon’ble Judge who remained neutral without taking any correction or action.
2) As related to this maintenance case, the petitioner also has two more bank accounts (Karnataka Bank and SBI) and no information about those bank accounts is shown in the assets and liabilities affidavit. This information is supressed from the court. We have filed an application dated: 26/12/2023 under Section 91 Cr P C seeking to produce the information and documents supressed by the petitioner before the court, (also produced petitioner’s both bank account no and branch). If the court that accepted the application is delaying without summoning the concerned banks to present the documents to the court, it raises doubts on the Hon’ble Judge.
3) Hon’ble Judge has also ignored the fact that the account of the Petitioner in Karnataka Bank is still active and the payment receipt has been given. 4) I, through my advocate, have appealed to the Hon’ble Judge and, regardless of consideration, have ordered the execution of a warrant for mental torture against me for the arrears. But the petitioner also supressed the bank documents from the court but took a neutral stand without taking any action.
What legal steps i need to follow...Please suggest and advise me.
