In my village, there are many fields in various locations. My step sisterinlaw has filed a false partition lawsuit based on incorrect facts. The incorrect fact is that her share should be 1/12, but she is demanding 1/9 in the case. However, my mother and I are entitled to a total share of 1/6. My step sister inlaw is a dominant woman, and with her influence, she has taken possession of all the valuable fields and those located along the road, while giving me only barren and poor land. She has also managed to obtain a stay order on the fields using fraudulent methods. The case has been ongoing for 7 years. The case is under Section 116 of the Uttar Pradesh Revenue Code 2006. To make the barren land cultivable, we removed the topsoil up to 15 inches, but the dominant woman filed a police complaint saying that removing the soil violated the stay order. On the police's advice, we immediately stopped the excavation of the soil. Now, the dominant woman is preparing to frame me in false cases.
Please let me know if removing the topsoil from my share of the land to make it fertile is a violation of the stay order. The local police are only listening to the dominant woman and not my side. Where should I file a petition against the dominant woman for action to be taken against her? Also, if there has been no order in the case, what should I do?
