My family lived in a property for more than 12 years in Veraval, Gir Som

My family has resided in a property in Veraval, Gir Somnath for over 12 years. During this period, I have consistently paid all electricity bills and taxes. Additionally, all our bank details, ration cards, and Aadhaar cards are registered at this address. We purchased the property from a builder and paid in cash; however, the builder never formally transferred the property to us. Since the property was newly built at the time and we were already living there, we settled in. The builder subsequently disappeared without a trace, and we did not receive any eviction notices for over 12 years. Despite our efforts, we were unable to contact the developer/owner, Mr. Nilesh Shah. In short, we are in “open” and “consistent” possession of the property. In 2020, we received a notice from our local electricity company stating that a request to change the name on the account had been made by Mr. Vajubhai Solanki, who claimed to have purchased the property from Nilesh Shah. Based on the deeds submitted by Mr. Solanki, the electricity company proceeded with the name change, despite our challenge. On 7 December 2024, representatives from Union Bank visited our home, inquiring if I was Ashishbhai Solanki. They informed me that the property is under a home loan which is not being paid by the new owner. I am perplexed as to how the bank released the loan funds without conducting due diligence to ensure the property was possession-free and not occupied by anyone with a potential ownership claim, such as my family. We have not received any payments or loan statements addressed to Mr. Solanki at this address, which we have occupied since purchasing from Nilesh Shah over 12 years ago. I seek advice on how to protect my family from eviction and clarify that I do not intend to pay someone else's bank loan. It appears that the bank is at fault for releasing the funds without proper checks. Additionally, a few years ago, we received a visit from the local collector, who stated that we were in illegal possession of the property. We appealed in writing, explaining our situation, and the collector confirmed that no further action would be taken, allowing us to continue living there without harassment. This indicates that even the local authorities acknowledged our legal possession of the property for over 12 years and the transfer of ownership to us.
