We are having a agriculture land which was bought in 1992 as join property of six brother,the land area is 5.05 cent as per document.South side of our land there is another person who is having agriculture land of 5 acres as per document,he is local guy & we are 70 km for away from this land.This both lands where are on d same survey number for past years..As our family members decide to do partition we requested to survey this land at taluk office land survey department.we informed to our neighbouring land owner to come n see while surviving,first time when land was measured in tape d neighbouring person did not accept n requested for digital Gps land survey n it was then again measured n d surveyor confirm tat there is shortage of land of ten cent where it found to have 9.95 cent so it was equally divided to both of us like 4 acre 97.5 cent per each n d boundary where placed with stone n congeret.Later on we 6 family members made partition as 5 part of land where one of our family member took money n went out ...But after this measurement done by surveyor d neighbouring person was inside our land n he asked time 45 day to vacate d the land as he did some cultivation n need time to harvest n we accept it but later on he filed a suit on us climbing for adverse possession
But we did registration 3 month back on our 5 family members name n received individual patta on our name n sub division order copy was also issued on our name . Neighbouring land person is now not allowing to put fencing on our land n failed a suit in court climbing tat he is using d land for past 32 year as he bought in 1995
Wat is d solution for this...As d real owners of this land can't we vacate him...he has put a small hut for cattle n a small pond of 2 cent for water storage.....
