Parking Space

I'm from Kerala. I own an apartment in a commercial cum residential building. The occupancy certificate was issued in 2007 and the Flat Owners Association was registered in 2008. Even though the Byelaw and the Affidavit given by the builder at various courts (including the Hon'ble High Court of Kerala) mention that the cellar area is for the exclusive use of it's residents, the builders are not allowing us the freedom to use the cellar car parking area exclusively. The shop owners forcefully park their vehicles in the common area for residents. The builder claims that the whole property is in his name and will do as he deems fit. He has now forcefully encroached on one cellar parking and parked his car claiming that as a builder he has every right to own a car parking at the cellar area. In 2022, he even sold 2 car parking slots by way of a sale deed. We have now approached the Court challenging this sale deed. Does the builder have the right to own the common areas? He says that the title deed is in his name and he is the owner of the maximum undivided share as he owns many shop rooms and will do as he feels. All flat owners are paying the property tax annually. Please advice how to overcome this situation.
