Bangalore Karnataka:- RWA is imposing a heavy penalty and Monthly charges for a rental unit constructed
I am a resident of Bangalore, and I have constructed 3 residential houses(3 floors) for rental purposes on my villa plot(Residential converted land).The Resident Welfare Association (RWA) is proposing to impose charge and a monthly charge for the 3rd rental units constructed on my plot.
Below are the details of the charges proposed by the association(RWA allows 2 houses on each plot):-
> Monetary Penalty Structure for New Violations:
Violation on Constructing a 3rd Unit:
Fine Amount: 10-20% of the property’s assessed value or a minimum of ₹10,00,000, whichever is higher.
Justification/Explanation given by RWA: This substantial fine applies upon the addition of a third unauthorized unit and is designed to deter initial violators and emphasize the importance of compliance with community standards and resource management.
> Penalty for Existing Unauthorized 3rd Units and Beyond:
Monthly Penalty for Already Constructed 3rd Units and Beyond:
Penalty Amount: ₹20,000 per month
Justification/Explanation given by RWA: For properties with existing unauthorized third units and beyond, a monthly penalty of ₹20,000 will be levied as long as these units are rented out. This charge aims to mitigate ongoing resource strain from these units and encourage owners to cease renting them.
Could you please let me know, Resident Welfare Association is allowed to make such rules and apply such a heavy fine or charges?
