Want to build shed on my Private terrace
I recently bought a flat in the Mumbai suburbs. Our flat is located on the second floor and includes a large private terrace that is part of our personal property. We are planning to construct a shed or awning roof for several reasons. Firstly, we have experienced incidents where people from the flat above throw garbage or items out of their windows, which sometimes land on our terrace. Additionally, dirt and dust accumulate from above. Beyond these concerns, we also want to build the shed for safety reasons, as various materials have fallen onto our terrace in the past.
Another flat owner with a similar terrace constructed a proper shed several years ago. We consulted with the building secretary, who confirmed that constructing a shed would not be a problem as long as no one objects. However, the resident above us is the only one raising an objection. He claims that if we build the shed, garbage could accumulate on it, which would be visible from his window and will attract insects (we offered to get it cleaned regularly). He is also concerned that rats might enter his house through his window via the shed.
Do I need permission from the BMC to build a shed on my private property? If one member is objecting, what are my options?
