Landlord Absconded with 6 Lakh Lease Deposit, Police Not Taking Action – Need Advice

Hi everyone, I’m in a difficult situation and hoping to get some advice on what to do next. I live in Coimbatore with my wife and 2-year-old child, and we’re currently facing financial distress and threats due to a lease deposit issue with our landlord. Background: In September 2023, I leased a property with an 11-month agreement and paid a 6 lakh deposit to my landlord. Since July 2024, I’ve been asking him to return my deposit, but he keeps giving false promises and delaying it. I’ve recently found out that the house is under NPA with LIC Housing, and he has taken loans from multiple banks using this property. Actions I’ve Taken: 1. Police Station: I filed a complaint on September 17, 2024, at the local police station. After multiple visits, they told me it’s a civil matter and advised me to go to court. 2. SP Office: Frustrated, I submitted a petition to the SP office on October 10, 2024. However, the local police still haven’t acted on it, and I keep getting the same response that it’s a civil case. 3. Locating the Landlord: Recently, I found out the landlord's location and informed the inspector, who initially agreed to send officers but later asked me to get a court directive for a FIR. Threats and Intimidation: The landlord has also been sending intimidating voice messages, saying things like, "Without my wish, you won’t get the money" and threatening to cause issues if I pursue this further. He’s even hinted at drastic actions if I keep calling or pressuring him. My family is feeling unsafe, especially with bank agents coming to the house daily because of his debts. Current Issues: Police Inaction: The local police seem unwilling to help, possibly due to the influence of a local association head as this house builder and seller , who’s been supporting the landlord. Financial and Mental Distress: Our lives have been severely impacted. We’re financially strained, and I worry about our safety due to constant disturbances from bank agents. Questions: 1. Is my case really a civil matter, or can it be treated as a criminal case given the circumstances? I’ve read that sections like IPC 420 (Cheating), 406 (Criminal Breach of Trust), and 506 (Intimidation) might apply. 2. What are my options if the police refuse to file an FIR? Has anyone had success with court-directed FIRs, and how costly or lengthy is that process? 3. How can I ensure my family’s safety in this situation?
