Forceful eviction licensee
I have given my shop on rent for tution class on leave and license agreement.
(1) agreement was of leave and license, duration 5 years, notarized on 300/- stamp
(2) licensee has given security deposite. He put his furniture inside. Then paid license fee regular for two month only. Then not paid anything (till time passed six months)
(3) He has not open shop for single day. On asking on call he told he does not want to continue. And he will take his belongings soon.
(4) Till date he does not come to take his furniture. Which is still not installed.
(5) on repeated calling, still he tells he will take his belongings soon.
(6)I have wait till his security deposit amount (4 months security deposit). But he did not come. Then I gave him termination of contract notice due to breach of conditions through post and gave 30 days time. But still he did not come. He only hanged lock, Doors are open.
(7) In agreement it was condition that owener can enter the premises whenever necessary.
(8) Also it was mention, on termination or non payment of license fees, licensee has to vacant the premises.
Questions:
How can I evict him. Can I put his belongings otherwhere. Can I change locks?Can I give my shop to other Or Can I use it for personal use like office. ? Please suggest as my ultimate goal is to evict him. I feel he cooks something fishy.
