Girl's parent filed false case of 406 and 506 after broken engagement
I am 36 years old male working in USA. My parents in India, received a matrimonial proposal from a girl's parent. I spoke to the girl two time on phone, and although I was not sure about the nature of the girl, I left the decision on my family.
My family visited girl's family at their residence in another city, and after a couple of weeks from the visit, they agreed to conduct the Roka ceremony. The Roka ceremony was held in my absence, and the marriage date was fixed from 7 months from Roka. I and the girl did not had any conversation for 4 the first 4 months of 7 months. After 4 months, I initiated the conversation with the girl and I found the girl's behaviour has been substantially changed since the first time I had spoke to her: she has been talking very aggressively, and disrespectfully. I tried conveying this to the girl that I do not like her disrespectful behavior but it did not make a difference to her. After one month of contemplation, I decided to break-off the Roka. This happened two months before the marriage due date. I never met the girl in person.
Before or after Roka, my family had not asked for any money from the girl's family but they insisted on giving some money and gave rupees 10 Lakhs to my parents. After the roka was brokes, my family returned all of their money. In additional to that, all the expenses for booking the marriage vanue, catering etc was done by my family, and my family did not ask for any reimbursement for this from the girl's family.
Now, after 2 weeks of getting back their money, the girl's side has filed a false FIR with section 406 and 506, against me and my father.
The following are the accusations they made in the FIR:
1. Girl's grandfather made claim that he gave rupees 15 Lakhs, a gold chain and ring worth 5 lakhs to my father, at the roka ceremony that happened at girl's grandfather home. In my absence, my father put the engagement ring on girl's finger.
2. After the roka, my father demanded 10 lakhs more a care worth 7 lakhs more. Because girl's family was not able to meet this demand, my father broke off the roka, and refused to pay back the money and the gold chain and ring.
3. My father threatened the girl's family that if they make a police complaint, my father will file a false case and make them rot in jail.
The following is the truth with respect to the each point above.
1. The roka ceremony happened at a hotel in my home-town. No money was exchanged. Only clothes and fruits were given. My family never visited girl's grandfather home.
2. Girls' family gave rupees 10 lakhs to my parents 5 months after roka at my parent;s home.
3. My parents returned the money after the roka was broken. (no receipt available)
4. My parents bore all the expenses for booking wedding venue, catering, photographer for the wedding.
Please advise how to deal with such false FIR in section 406 and 506.
