Can i file consumer court about EMI related issue on home loan
I am submitting this complaint due to unresolved issues with my home loan EMI payments and unwarranted penalty charges imposed by Bajaj Housing Finance, in conjunction with Axis Bank. Due to an uncommunicated change in the payment mode from Direct Debit to NACH, multiple EMI payments failed since August 2024, resulting in penalties totaling approximately INR 12,000, which I believe are unfair. Furthermore, I have endured significant mental distress as Bajaj Housing Finance has demanded penalties without investigating the root cause of the payment failures.
Background:
1. Change in Payment Mode Without Notification: From June 2019 to July 2024, my EMIs were processed successfully via Direct Debit (Tech Process). However, in August 2024, Bajaj Housing Finance initiated a switch to NACH mode without informing me, causing payment failures.
2. Miscommunication and Confusion Between Axis Bank and Bajaj Housing Finance: I contacted Axis Bank (previously Citibank) and learned that a new NACH mandate registration was initiated by Bajaj Housing Finance. However, the mandate details were confusingly shown as being associated with ICICI Bank, raising security concerns. To protect my account, I stopped the NACH registration.
3. Refusal to Waive Penalties Despite Providing Evidence of Sufficient Funds: I have repeatedly requested Bajaj Housing Finance to waive the penalties, as my bank account consistently held sufficient funds to cover the EMIs. The penalties have been imposed solely due to the unnotified change in payment mode, a factor beyond my control.
