What should be the charge?

Sumit is an NRI settled in London. He had gone abroad from India along with his father Mohan when he was about 3 years old. Sumit's grandfather Jagmohan expired in Feb 2024. Sumit had visited India for the first time along with his father to perform the last rites of his grandfather in Chandigarh. ● During the duration of their stay in India, Both Sumit and Mohan were staying in the house of Mohan's real brother Sohan. Sumit and Mohan stayed back in India after performing Jagmohan’s last rites. The purpose of their stay was to resolve the pending property matters and Mohan also wanted to arrange a marriage for his son Sumit. He had also declared his intention to get his son married in India on numerous occasions. ● While staying at Sohan’s house, Sumit was introduced to Sadhna, who was the niece of Sohan’s wife and was residing with them for the purpose of her education. Sadhna came from a village and was pursuing her studies in Chandigarh since 2022. ● Being the only two youngsters in the house, Sadhna and Sumit formed a close friendship. Meanwhile, Sumit and his father’s stayed in India for settling the property matters. Sumit was introduced to a few girls for the purpose of marriage, but he would refuse giving one reason or the other. Being a member of the family, Sadhna was aware of Sumit’s plan to get married. ● Around April, 2024, the affinity between Sumit and Sadhna grew and Sadhna conveyed to Sumit, her feelings of love towards him. Sumit reciprocated the feelings and they started seeing each other secretly. Despite coming from different backgrounds, the two decided to get into a relationship. ● In July 2024, Sumit insisted Sadhna to get into intimate relationship, she agreed to the same. During the course of their relationship, Sumit would often worry whether Sadhna would be able to adjust to his life in London. ● There was an ongoing tiff between Mohan and Sohan regarding their father’s property. In July 2024, Mohan filed a civil suit seeking partition of his share in the property left behind by his father Jagmohan. After filing the suit, they moved out of Sohan’s house and were residing with another relative nearby. Due to this, Sadhna and Sumit were struggling to get along and in Aug, 2024. Sumit broke up with Sadhna and refused to meet her thereafter. ● An FIR for Sexual Assault is registered in Aug 2024 on the statement of Sadhana against Sumit, currently Sadhna is 25 years old and Sumit is 29 years old.
