Wrong doings of Builder
I had booked a flat with one of the builder in July 2014 with possession date of October 2018 as per Builder Buyer Agreement. The builder failed to provide the possession and after waiting for almost 3 years, I went ahead and filed complaint against the builder in UP RERA for refund with interest in August 2021. UP RERA ordered refund with interest in March 2022. The builder failed to comply with the order for more than a year and UP RERA issued Recovery Certificate RC in my favor in May 2023. Meanwhile, I along with a group of buyers filed petition in NCLT to remove the current management and bring a new management to complete the project. Builder then sent a DD of 10% of refund amount to UP RERA to weaken the NCLT case by bringing the legitimate buyer count below the minimum threshold. Since the project had secured SWAMIH fund for last mile completion, NCLT ordered Builder and SWAMIH fund to complete the project by May 2025 and give flat possession to all the petitioners. The builder has recently submitted the DD of remaining 90% of refund amount with UP RERA and is not willing to offer possession to me. I haven't received a single amount so far from UP RERA and had informed UP RERA, DM and Tehsildar via email about the NCLT order and my willingness to take possession of the unit. What could be done here to secure my flat's possession instead of the refund from builder via UP RERA
