Harrasment and Illegal Termination
I am a confirmed employee of my organization in the IT department.
During last appraisal cycle I was not provided any increment nor bonus stating my performance is very poor by my Managers. However they did not provide any documentation or instances of issues in performance.
So I approached HR team to look into the matter as there was never any issue related to my performance.
I also asked them to share the appraisal feedback submitted by my Managers.
However HR did not investigate the matter and when I asked for update they replied on email that your manager is not ready to investigate the matter and we cannot do anything. I had sent multiple reminders to atleast share the appraisal letter with feedback and have not received yet.
Post that my manager removed me from my project and handed it over to another employee who had joined the organization after me. The other employee was on bench with no work for 3 months. They did not provide any reason for removing me from the project. The HR team was present during the entire conversation.
I raised a complaint with HR but didn't even receive any response. The HR team has stopped responding to my emails.
Post 1 month of my removal from project, the HR team along with my Manager scheduled a meeting and said to me that we do not have any projects and you need to resign today and 30 days from today will be your last working day.
I did not resign on that day so after 2 days the HR sent me a mail stating that you were supposed to resign after the discussion but you didn't. A warning was also mentioned in the email stating that I need to resign as soon as possible else we shall update your resignation from our end. Also we shall be revoking your email and all your access within next 2 days.
As per my contract there is a 90 days notice period but they are adamant that I will have to serve only 30 days notice period. I stated the same still they were adamant.
Fearing that HR would resign on my behalf using Admin access and will update any invalid reason for resignation I was forced to resign. And as soon as I resigned my entire access from the company was revoked.
Even the CHRO of my organization was not responding to mails.
Please guide me as to how I can seek justice in the matter.
