Residential Right
I got married in November 2017 and became a mother to a son in December 2018. My mother-in-law was a cruel lady from the beginning of our marriage, but I managed to cope. My husband was very irresponsible, and during the COVID-19 pandemic, he started drinking heavily, leading to numerous issues in our marriage. Then, in October 2020, on my husband's advice, I went to my parents' home for some time. However, they refused to take me back to our house. My mother-in-law filed a Domestic Violence (DV) case against me, which was dismissed due to non-prosecution. I also filed a DV case and obtained an ex parte order, granting me either residential rights in our matrimonial home or a maintenance of ₹5,000 per month from my husband. However, my husband is not willing to pay the maintenance. He has been working in his father's business, but due to court cases, he has been dispossessed of his share in the property. My husband is the only son of his parents, but he does not have any assets in his name. Now, he is in jail for a month for not providing maintenance. I am still struggling with accommodation issues.
How can I reside in our matrimonial home if they won't let me enter the house?"
