Extension in notice period from 1month to 3months
I have joined my current organisation in 22-Dec 2021 - As per my appointment letter letter i had below norms for notice period - “After confirmation, your services may be terminated by either side, without assigning any reason, by giving One (1) months notice in writing or salary in lieu of.”
On Jan 2023 i had received mail from hr for extension in notice period, as below-
The clause related to notice period in your appointment letter stands amended as, “After confirmation, your
services may be terminated by either side, without assigning any reason, by giving three (3) months’ notice
in writing. Notwithstanding the above, the Company reserves the right to terminate your services forthwith
or with lesser notice period by paying you salary in lieu of such short notice period. In the event you decide
to terminate your services with the Company for any reason whatsoever, you will have to serve a notice
period of three (3) months. This notice period is compulsory and you cannot make any payment to the
Company in lieu of the notice period for three (3) months. No notice of resignation will be effective if it is
given during the leave period and at the same time, you will not be eligible to proceed on leave during the
notice period.”
In acceptance of this letter, please send a signed and scanned copy of this letter to your HR Partner.
For the above notification mail i have never replied also, have not shared my acceptance on mail/physical document copy.
Neither i have got any reminder on mail / in person to share my acceptance for extension in notice period.
Now as i had resigned on 20-Aug-2024, company is enforcing me to serve 90 days notice period.
Also stating if i leave organisation before 90days they will abscond me.
My question is here is :
1. Does i will get proper relieving letter/will get absconded if i leave by 21-sep-2024.
2. HR is now saying there was no denial email or any objection received from your side on the aforesaid Notification, hence it is deemed to be accepted.” - what should be my notice period now.
