Dealer delivered defected car on the day of delivery
On 07th SEP 2024, we reached the showroom to take delivery of new car. They took us to the office and asked us to sign a few documents related to bills and insurance and afterwards they will show us our car. As this is our 1st car, we trusted the dealer and signed the documents.
After signing the documents, they guided us to visit the car. Car was muddy and uncleaned. They said they are just going to clean it.
Upon viewing the car closely(Model: Grand Vitara Delta CNG), I identified several defects specifically, “dented” on the exterior part, there are scratches on the whole bonnet and bumper and some other places.
When we asked for justification for the defective vehicle, they replied these are due to natural causes which we cannot control. So, you must understand. After so many arguments, they agreed to replace the bonnet and bumper, but asked me to take the dented car as they can’t do anything about that.
When we asked further if they can not fix the dent then to provide a discount or refund the money as this will be repaired car for us not new anymore or cancel the order. However, they ignored me and behaved like nothing serious happened. Lateron his GM asked for 3-4 k compensation for dented car.
I have declined to take the delivery and left the documents and car at the dealer’s showroom.
As there is sign on the undertaking document is it possible to go in consumer court and are there any other ways to tackle this issue. ?
I have filed complaint in their costumer service centre.
