North-East Parking Issue for Apartment Flat in Hyderabad

In August 2019, we purchased two flats in a well-located apartment complex in Hyderabad. Flat 5-1 is in my father’s name, and flat 5-2 is in my mother’s name. My father passed away a couple of years ago, and the legal heir process for flat 5-1 is ongoing and should be completed soon. An NOC for Stilt + 5 floors was obtained later. When we purchased the flats, all 5 floors had already been constructed and sold to residents. Since purchasing the flats, we’ve been parking one car inside under the building (for flat 5-1) and one outside (inside the compound wall, now covered). The outside spot was initially uncovered but was later covered without causing concern from the residents. Recently, the new owner of flat 3-1, who purchased the flat directly from the landlord after it was freed from a bank mortgage, is claiming that the parking spot under the building was allotted to him by the builder and landlord. The builder and landlord, during a verbal call, confirmed that the covered parking spots belong to the first 4 floors, while the outside ones (inside the compound wall in the setback area) belong to the 5th floor. However, the residents are not allowing us to use the North-East parking spot and are asking us to resolve the issue with the builder or landlord. Sale Deed Details: All 10 flats in the building have sale deeds specifying 100 sq. ft. of parking space. However, none of the parking spots were officially allotted on paper, and it has been a matter of mutual agreement between the residents. There is no registered Residents' Association, as the building only has 10 flats. Request for Advice: We are seeking advice from members of this forum on how to proceed with this issue. Our key concerns are: Parking Allocation: There should be 10 parking spots for 10 flats, but currently only 8 exist. The other two are in the shared/setback area, with one of them causing concern for all the residents. Legal Action: We are not comfortable filing a legal case against the residents, as they are generally good people. However, if we have no other choice and it is legally allowed, we are willing to proceed. Parking Rights: Are we within our rights to ask the builder/landlord to officially allot us our parking spots? Alternatively, can we ask the court to allow us to park in the builder/landlord allotted North-East spot, even though some residents oppose it due to its location in the setback/common area? Your guidance and advice on the best course of action would be greatly appreciated!
