Separation of the existing society and the collection of maintenance charges
Hi,
I am staying at a co-operative society in Pune. I got provisional possession from the developer in 2019, followed by formation of a society registration. We are staying at C wing of the said society. There were 2 wings (C and D) in function at the time of society registration. In nov 2022, developer has called a meeting of all the members, chairman has been Mutually ( not elected ) by the members from D wing, also another 14 members identified as a managing committee from both the wings. It was decided that office bearer ( Secretary and treasurer) will be further identified from the 14 members and the managing committee will be in function for next 1 year.
Till here, things were in a proper shape, however the disputes were started between C and D wing members at the time of choosing the Office bearer, i.e., Secretary and treasurer. Somehow member from the D wing able to manage to appoint rest of the office bearers from the D wing. Most of the members were shocked by this decision where no one was there in the office bearer position from C wing. Due to this incident, few people from C wing have decided to create a separate entity ( separate co-op society for C wing). We ( C wing members) have been verbally informed by these people that the separation process has been initiated and the same will get completed soon.
These 8-10 people form C wing has started collecting the money from rest of the members (C wing) to perform the separation activity and manage day to day operations. It’s been almost more than 1.5 year; till date we haven’t received any updates on the separation.
Here is the key points on which we are looking for further guidance.
1. We requested them to share the updates to these peoples who initiated the separation, no information has been shared so far – Would like to know how to get the update on the society separation.
2. Money is being collected ( as a maintenance changes) in a personal account, all the expenditures were done without a proper process ( e.g. without discussing between the members ) no proper details being shared upon the request related to the expenses. Would like to know if this is a valid/legal way, if not what should be the corrective action can be Initiated by the member who anticipate an update on this issue.
3. Currently few members have stopped paying the contribution since the team ( people who collect the amount) is not sharing any updates on the ongoing activities and reluctant to share the updates on society separation and other vital things. Would like to know if there is any way to stop these people from doing such act which is not beneficial for rest of the members.
4. People are being pressurized to give the money, though there is no elected committee exists. Would like to know your opinion to stop this further.
