Right to Education is violated.
My niece's family is facing a challenging situation with the education of their three sons. The two older children were initially enrolled in a top private school in Bidar, which they could afford at the time due to her husband's good earnings. However, as time passed, their financial situation worsened, and they began relying on petty loans to manage their household expenses. This financial strain made it increasingly difficult for them to pay the school fees.
Over time, their debt accumulated, and they defaulted on fees amounting to nearly 2 lakhs. As a result, the children missed significant portions of the school year, eventually staying at home for more than half of every academic year. Now, they have reached a point where the children haven't attended school for a couple of years due to non-payment of fees.
The family is now planning to admit the children into a government school. However, the private school is refusing to provide the Transfer Certificates (TC) required for admission to the new school, unless the outstanding fees are paid. The government school, on the other hand, is not willing to admit the children without the TC.
This situation is causing the children to miss out on their education, which violates their fundamental Right to Education (RTE).
Request:
Is there a way to request the private school to provide the TC, or is it possible to gain admission in Karnataka or Telangana (Hyderabad) schools without the TC under these circumstances?
