Divorce based on irretrievable breakdown of marriage
My name is Mohammed Tajuddin and I’m 24 years old and from India, Bapatla based from Andhra Pradesh.
I have been married since 5 months and the commission of my marriage is based on undue influence from my parents as they were threatening me of eviction consequences if I don’t marry against my will for the sake of contributing the characteristics of their family honour and legacy. I couldn’t do anything when my parents have threatened me for marriage because of fear that I would be evicted from their home since Supreme Court already declared a law which identifies the legislation of eviction terms and the adult children don’t have the right to live in their parents home be their admission of residence is based on their leniency and consent so I couldn’t do nothing about it.
I’m aware that there are laws fir extortion and correction and unlawful assembly and criminal intimidation and violence and many more and even though my parents are convicted for the crimes then I wouldn’t still be able to live in their home nd it’s high unlikely that the police would take action against my parents since they are old.. my mother is 55 years old and my father is 65 years old.
Right now I need information regarding the divorce settlement and the grounds of dissolution of divorce based on “voidable” marriage.
Since I have been married against my will, is it possible to consider the marriage void? According to my experience of research, I came to an understanding that Muslim marriage has no terms of “void” category for dissolution and my wife is not agreeing for mutual divorce due to “sacred” reasons and I believe “contested divorce” may take years so can I directly approach he Suprme Court based on the “irretrievable breakdown of marriage?
