My father has a NBW issued in his name in cheque bounce case. Is it possible to get bail in this?
My father had a collaboration agreement with a party and a security my father gave them 2 cheques of same amount. Due to some reason my father was not able to complete the full collaboration work and after some time the opposite party placed the cheques in bank and it got bounced. Then they filed a cheque bounce case on my father. My father used to live abroad for work. First date of hearing of this case was 12/05/2016. My father was not able to attend this date. On 7/07/2016 my mother died by suicide. We had some financial transactions with some people and they used to come to my home and harrass and because of this pressure my mother took this step. We even filed a police complaint for this but no steps were taken. Due to all of these situations and threats my father was not coming to home and that why he was not able to join the court hearing dates. As he was abroad we didn't took the notice and summons of court. After few date on 13/1/2020 court directly issued the NBW again my father and in august of 2022 the court disposed off the case and stated the reason as: Case Disposed: PO Un Contested. Now my father wants to come home and as he has NBW against him so the police will arrest him. In this case is it possible for us to get bail and on what grounds. All your points would be very helpful for us in this situation.
