Ex employee joined the competitor
Hi Team,
One of my ex employee has joined a competitor, where he has already signed a clause same below, now he is trying to affect my business and customer reputation in the market. What legal action can we take on that employee or send an email to his current organisation..
Non-Competition Restrictions.
• During the term of your employment and for two (2) year thereafter, you shall not encourage or solicit, either directly or indirectly, any employee of the Company / Clients to leave the Company / Clients for any reason or to accept employment with any other Company. As part of this restriction, you will not interview or provide any input to any third party regarding any such person during the period in question. However, this obligation shall not affect any responsibility you may have as an employee of the Company with respect to the bona fide hiring and firing of Company personnel.
• You agree that you shall not either on your own behalf or on behalf of any third party, except on behalf of the Company, directly or indirectly, as an individual proprietor, partner, shareholder, officer, employee, director, joint ventures, investor, lender, or in any other capacity whatsoever, engage in any business that competes with that of the Company or its Affiliates’, or accept employment or be engaged in any manner whatsoever, with any entity (Competitor) that engages in any such business activity
