Guardian misc case

The applicant is the natural mother of the minor daughter Malati Pradhan . Father of the minor and husband of the applicant Kalandi Charan -Pradhan died on 23.08.2017 As the applicant is the natural mother of the minor girl Malati Pradhanand the minor daughter is in the custody of the applicant and also looking after the welfare education of the minor . The minor has also another two sisters namely Arati Pradhan and Bharati Pradhan who are also the legal heirs and successors of Late Kalandi@Kalandi Charan Pradhan along with both the applicants , accordingly out of 4 legal heirs of Kalandi Charan Pradhan legal heir serial no-1 & 4 both are the applicants in this application. However another two legal heirs who are in serial no-2&3 both are the opposite party no-3&4 . Similarly Co-sharer of the scheduled property along with minor daughter and her natural mother stands recorded in the name of Debaraj Pradhan . who died in the year about 28.02.2018 and leaving behind his one daughter and one son namely Santosh Pradhan and Minati Nayak , both are the Opposite party no- 1 &2 respectively . but the dist judge refusing to allow my guardian misc case , as because the scheduled land has not partitioned because , the ROR HAS BEEN RECORDED JOINTLY . .
