Can AoA build a commercial activity like Start a new Cafe in common area, also there is already a cafe running for over 10 yrs
My question is Can AoA build a commercial activity like Start a new Cafe in common area, also when there's already a cafe running for over 10 yrs approved by bulider.
Can AoA collect late penalty at 5% per month. If they have collected what should be done?
Can AoA terminate a vendor or vendors at a time like housekeeping, plumber, maintenance etc and approve a new vendor without any approval from residents in AGM/EGM.
Can AoA increase rent at 10% every 11 months for a commercial place like restaurant, cafe, ironing, car wash etc ( condition is only residents can avail this services). Now the rent is increased every 11 months and at one point the rent is higher than the rent of the commercial property which is outside a residential complex.
Which make the person running a restaurant, cafe etc difficult to pay it's over heads like rent and maintenance.
Also they can not charge a high price for the services else there won't be any business.
The AoA has collected 5% late fee with GST and collected late fee on late fee at 5% with GST for not paying the rent in time. ( Due to constant increase in rent which very high compared to commercial property outside the residential complex).
They are also terminating the contract of a cafe stating non payment of rent for continuous 3 month ( this clause is mentioned in the agreement). Yes the rent is not paid in full but rent has be paid partially since there is no business and competition as they have opened a new cafe which I mentioned earlier above in common area.
Please guide since this is the only bread and butter for me as I've lost all other business.
