Family and estate issues
Hi, I'm seeking advice regarding family and estate issues: 1. I’m the youngest brother with two older sisters. I'm married and stay separately on rent with my wife in the same city. My oldest sister lives with our father, who is in his mid-80s and losing mental balance. My middle sister resides abroad. My mother passed away several years ago.
2. I have a strained relationship with my oldest sister, who has manipulated our father and middle sister against me.
3. About two years ago, my father gave me his original will and the house agreement, anticipating that my oldest sister would contest my rights to the property after his passing. He also opened a joint locker with me for these documents. Additionally, my father opened fixed deposits (FDs) with me, constituting my 1/3 share of his financial assets.
4. Recently, my father has claimed that more money has been allocated to me than to my sisters, and that I should return the extra amount. However, this is not true. I have the original FD receipts. He also wants me to return the original will and the house agreement.
5. I have several questions: - My father is the first holder and I am the second holder of the FDs, which are linked to his savings account with my oldest sister. Can he dictate that the FD proceeds be credited solely to his account at maturity? Is he legally entitled to force me to return the will and house agreement? If he creates a new will, can it be contested due to his age and mental state?
Any guidance on these matters would be greatly appreciated. Thank you.
