Builder delaying return of money per MOU
Sir/Madam, I have signed an MOU along with my cousin in Mar 2014 for Rs.50 lakhs to a Property Venture in Bengaluru promising return of capital & interest for a period of 6 months. We have been pursuing this since years but they kept delaying due to some reason or other.
Most importantly the Property company is co-owned by my close relatives on my sister's in-laws and we were hesitant to take any serious steps to recovery. Moreover every time we tried to pursue, they have not replied to our phone calls or willing to even meet us.
The other partners of the Property Venture are selling their share of land it to their customers and making money and not entertaining any of our requests.
Recently, my relative (the co-owner of the Property Venture) passed away and his wife is entrusted with the ownership. She is not very knowledgeable about this affairs and others are helping her navigate the paperwork. The MoU says that in case of default of money, land/plots will be given to us. But at this time, we are not sure if any plots/land is available to make good on our agreement.
What is our process of due recovery. Of course we would like to avoid a lengthy / legal process. Thanks in advance.
