My vehicle seized

Hey nitin this side. I wanna know that at 19 June 2024 at approx 9 pm my father who is a travelling agency holder was going with passengers from haldwani PITHORAGARH . As he was leaving haldwani near gaulapar gaulapar 4 way road as in highway the speed of vehicles are comparatively more . So he was driving under the speed limit . Suddenly a man in 🚲 bike along with his son was a local of that area. Crossed the highway road from one end to another end without even looking while crossing the road . And suddenly the vehicle of my dad and the bike clashed. And he was suffered from a head injury and his son from a leg injury. My father informed the police . And let all the passengers go to PITHORAGARH in another car because they were running of time. And then we admitted both the victim in nearest hospital and when the police came they siezed my father's car. And the man is unconscious and going through treatments doctors said he would be conscious after72 hours . Therefore i want to know if there would be any legal action against my father . And if how shall we defend it .
