Case regarding rfa

Hi , This is for a property related to a hindu family . There are 6 childrens say A,B,C,D,E,F out of which one son A takes GPA from all others siblings and using that GPA he sells the property to Party X by executing a sale deed . Now that all other siblings has filed a partition suite on A and also included party X in the suite i . e BCDEF has filed case on A and X. After few years BCDEF executed a confirmation deed in favour of party X stating they all accept the above GPA and also Received some amount for confirmation deed executed . On top of this the city Civil passed a judgement stating that BCDEF has to take their partition from A and not to ask party X as they have already settled the amount to A. After all these developments BSDEF approached high court and got stay for the judgement of the city civil court. Its been more then 6 years in high court and the case has not started the hearing of the case. My question is Can we build a home in the above said property . Or is it possible to vacate the stay that they have got in high court. We need to construct home immediately . kindly suggest a resolution
