Leave Licence Agreement - Licensee terminated Agreement within the Lock in Period - Not paying rent nor vacating
The Leave Licence Agreement was for the period 17th October 2023 to 16th September 2025 with lock in period of one year. On 19th February 2024, Licensee terminated the Agreement through Legal Notice citing the Licenced premises (Ground Floor Flat - Residence) in uninhabitable because a steel beam has been installed to give support to roof of flat located on the second floor of the building. Thereafter repeated termination through another legal notice and said that ready to handover the keys and vacant and peaceful possession of the said flat. But not giving vacant and peaceful possession, letter to this effect nor handing over keys. Demanding return of Deposit (Rs1,00,000), One month rent (Rs 43000) and Rs 35,000 towards repairs not approved by the Licensor. Not paid BEST / Electricity Bill for Rs 5000 and Mahanagar Gas Bill. Monthly rent is Rs 43000 and paid up to 19th February 2024. Rent Arrears as of 19th June 2024 amount to Rs 172,000.
