Parking Jammers and Penalties
Request to please help clarify the details with respect to placing parking jammers on the vehicles by the Registered Welfare Society.
1. Please advise if placing of jammers by the Registered Welfare Associations to any of the society member or guest vehicle, incase approved by the society committee in a resolution is considered legal per the law of the Maharashtra state.
2. If yes, does the jammer and the related penalty rules need to be specifically mentioned in the rulebook or any other society related document or does it fall under the MHADA, CRCS or Motor Vehicle Act or any other general rules? Request to please provide the section for the related Act/Regulation.
3. If the jammers are allowed, then What are the timings of placing the jammers? Is there a specific time when the jammer cannot be placed. Please advise if the society needs to roll out a written or verbal communication to the owner of the vehicle before placing the jammer or can place it without any information.
3. If this action by society is not legal, then on the basis of public statement by earlier Respected PCMC DCP Mr. Anand Bhoite, under which section of CRPC can this action be challenged.
4. With whom should the complaints be registered incase the jammer and penalty provisions are not legal. Please advise all authorities.
