Demarcation and evict encroached portion of land
I have a share (executed partition on mutual consent within our 3 brothers, title holder, and uncle) in 3 parcels (called khesra numbers) which are adjacent from east to west.
My northern neighbor always hides the facts about his rightful land area and measures his land from 20 feet away from a fixed point (the northern boundary "bandh"), which reduces my land area. This measurement process even happens when either party starts construction on the disputed land.
To address this, I assigned an Amin from the Land Record Office (Tehsil) to start measurement. After 3 days, it became clear that there was no space in the north boundary, i.e., the bandh, which was previously assumed to be 20 feet. This mismeasurement is the main reason for the reduction in my land area. When the measurement revealed this, the opposite party objected and stopped the government surveyor, halting the process.
Approximately 4000 square feet of my Agricultural land has been encroached upon by my neighbor. In some parts of the disputed land, a permanent house was constructed more than 12 years ago, while some parts remain vacant. This area now falls under the municipal area.
Please suggest a course of action to evict them and reclaim my land. I have all the rightful land documents in support.
