Home Loan not paid by the landlord and my lease amount is stuck with him

Hello Sir/Madam, My name is Sridevi, and I'm based in Chennai. I recently leased an apartment for 11.5 Lakhs, but since the lease term is only for 11 months, it hasn't been registered with the Registrar. There's no rent involved; I simply paid the lease amount, which the landlord is supposed to return when I vacate the premises. I moved into the apartment in May 2023, and the initial agreement ended in March 2024. However, both the landlord and I agreed to renew the lease, and a new agreement was signed for another 11 months, from April 2024 to February 2025. Shortly after the renewal, a representative from the bank visited and informed us that the landlord hadn't paid the home loan for the past four months and had posted a notice on the door. They mentioned that another notice would follow in seven days, after which we would have to vacate the premises within 60 days. Given the landlord's inability to pay the 25k monthly EMI for the housing loan, I'm concerned that they may not be able to reimburse the 11.5 Lakhs lease amount. I'm seeking legal advice on how to proceed with this situation. Thank You!!!
