Date of Releiving
I have resigned in my previous co. on 16 Nov 2016 and sent an e mail to my previous boss that I wont be able to serve the complete notice period after 30th Nov 2016 and requested them for early relieving. I have approached them multiple times however they have not shown any positive response on my urgent relieving request. I have also requested them to waive off my relieving period and I was also ready to pay the salary part as I was not in a position to serve the entire notice period of 60 days, still they have not shown any interest and not given any positive revert.
I left the co. on 30 Nov 2016 and later paid the dues against not serving the entire notice period of 60 days to get the relieving letter. On relieving letter the co. mentioned the LWD as 13 Jan 2017 but actual LWD was 30 Nov 2016. In the month of Dec 2016 I have joined one small scale co. and started working their. Now, the date of joining of new co. and the date of leaving the previous co. conflicting and creating dual employment. Which is actually not true. I was never in a dual employment.
Please help my understand that as per the employment and labour law can I take any legal action against my previous co. to get the revised relieving letter mentioning the actual relieving date of 30 Nov 2016. Please help.
