Can the Society chairman order stopping of water supply for any reason other than overdues ?
I stay in a owned flat in a cooperative housing society in Pune . 2 years back the owner of the below flat raised a concern to me that there is some seepage in their flat that was apparently due to some leakage from my bathroom . As we had not made any renovations or changes in the bathroom and were pretty much using it as it was handed over by the builder, we were not really willing to bear the charges of waterproofing alone. But as a good neighbor and showing empathy to their concerns, we performed waterproofing in the bathroom where we even changed a few tiles. After the waterproofing was done, the issue seems to have been resolved for nearly a year.
However in Nov last year (2023) , we received an official complaint from the society that there is still some seepage in their flat. We explained to the society that we have already spent nearly 8k in waterproofing the bathroom a year back and it could be remaining water that must be slowly draining out but they sent over a civil contractor also doubling up as a waterproofing person to check . He wasnt able to provide an explanation about how the seepage could have happened neither could he give a scientific way to diagnose it .Instead he was more interested in removing the floor tiles and replacing it as opposed to fixing the problem. Even so I responded to the society complaint and informed the society chairman that I am willing to share 50% of the cost in the tile replacement along with the owner of the flat below as it is an issue not caused due to our forceful changes in flat and also because the quote for the work was nearly 40k . The chairman said that he would talk to the owner of the below flat and inform me .However within a few days , society sent me another notice while I was out of the city and today cut off the water supply to my kitchen and bathroom without any prior intimation or any reason provided. Can a society deprive its resident of an essential service such as a water supply despite being a regular maintenance payer and for builder's poor construction and execution ? What legal option do I have to stop the society from taking arbitrary actions that cause us harassment ?
