Builder not giving keys eight year after executing Handing/Taking over. of villa
Booked a villa in Greater Noida in Jan 2011 for Rs.56 lakhs, enhanced demand in 2015 of Rs.9 lakhs including 24% interest for delay in first instalment while seeking details from builder. Paid in full. Delivery was scheduled for June 2013. Handing /Taking over letter signed in Oct 2015. Villa Allotment Letter( Builder Buyer Agreement stipulated execution of Tripartite Lease deed between Builder , Buyer and Authority -before giving possession. Authority not giving CC OC for default by builder. hence Tripartite deed not possible.
Filed complaint with NCDRC in 2019 . in 2023 NCLAT imposed moratorium on all projects of builder company although insolvency limited to just one project ( not this one) and others ongoing. Hence the case adjounred sine die . In exactly idendtical case NCDRC had awarded refund with 8% interest just before my last hearing.
Also filed complaint with EOW in 2019 FIR , police has filed the case with the court.
Builder made me write to EOW to withdraw my name and quesh proceedings. Which I took back and destroyed. But they have taken scanned copy of the same.
Keys to villa not given. Villa in bad condition. Builder trying to use me for relief to its jailed MD.
What are the options before me with moratorium in place and FIR filed with court?
