Experience certificate and full & final settlement withheld by employer
My employer has withheld my experience certificate and my full and final settlement. my last working day with employer was 22 September 2023.
1. The employer wants me to sign an undertaking forcibly which happens to be a part of exit formality and only on completion they will do the settlement. it includes caluses below
I am fully aware that any misuse or unauthorized dissemination of Confidential Information, will
expose xxxx Limited to losses, damages and costs (which are unascertainable at this stage), and
xxxx Limited shall be entitled to recover from me such losses, damages and costs incurred/
suffered by xxxx Limited arising from my breach of Agreement and this declaration and this
undertaking. xxxx Limited shall also be entitled to other equitable and injunctive relief against any
such breaches by me.

I hereby confirm that as per
clause 8 of the appointment letter dated xxxx, I am not joining company’s competitor in any
capacity whatsoever.
2. I have misplaced almost 6-7 year old company's hardware for which i have intimated the police station in writing and obtained their seal and sign. i have informed my company and asked them to deduct the cost of hardware from my full and final payment. Being a part of exit formalities the approval from IT department is not given.
What is the next course of action that i should take as i was forced to resign and now my compensation and experience certificate is withheld.
