Can I get early relive
The below mentioned is the clause of a company. Employee has served 50 days and requesting to early relieve showing the medical conditions of the wife . Employee has 72 leaves pending and no project alloted. Employee simply harrasing the employee.
Termination of Employment
Either party wil be entitled to terminate the contract of employment by giving three.
months' notice in writing.
ifyour giving a notice of termination is shorter than the above period, it shall be the
discretion of the company to either acceptsuch shorter period of termination or
adjust any leavedue to youor recover from you such amount from your dues
towards the shortfall in the notice period. In the event the company does not accept
the sald shorterperiod of notice of termination, the employee is liable to serve for
the full 3 months notice period.
However, the company has discretion to terminate the contract of employment
either by giving 3 months' notice in writing or salary in lieu thereon,
In theevent of the employee's failure to give notice of termination or failed to serve
the notice period after giving notice or leaves the organization during the notice
period, the company reserves its right to withhold the Experience Certificate and
Relleving Order apart from recovery of such amount of dues towards the shortfall
notice period.
The Company may. at its sole discretion terminate the Contract of Employment
without notice and / or salary ni lieu of notice, fi ni the opinion of the Company, the
continuance of your employment is detrimental to the interest of the Company.
Provided that, in the event of termination as provided hereinabove, all benefits /
perquisites allowances shall stand forfeited immediately, and you will only receive
any statutory benefits as applicable to you on the date of your termination.
