Termination of Employment and Training Fees

The company is startup based in Hyderabad it is permanent Work from home. I am fresher and my monthly salary is 15k (1,80,000 per annum). Below is summary of clauses mentioned in employment contract- (I joined in Oct 2023 so its 2 months now) Notice Period for Termination: Either party can terminate the employment by serving a notice of 30 days during probation and 60 days in confirmed employment. The option to pay salary (Gross) in lieu of the notice period is available with approval from the Company. Unauthorized Absence: Continuous unauthorized absence or absence without written permission for 5 days results in the loss of employment without notice, and the employee becomes liable to pay the Training Fees. Termination for Breach or Non-Performance: Termination may occur without notice for any breach of the Company’s code of conduct, policies, or non-performance of contractual obligations. The Company reserves the right to pursue legal remedies to protect its legitimate interests. Place of Training, Transfer, and Probation: The company reserves the right to decide the place and kind of training and may transfer the employee to any location, department, or establishment, including its Subsidiaries/Affiliates/Associate Companies. During training, employees are placed under probation for a period ranging from 3 to 6 months, depending on performance. Training Fees amounting to Rs. 50,000 are incurred by the company and must be repaid by the employee if they decide to leave the organization during the Training Period or within 1 year of completing employment. This amount is considered damages incurred by the company due to the sudden departure and the resultant gap in the system. Jurisdiction: Disputes related to employment are subject to the jurisdiction of courts in Hyderabad/Secunderabad. Questions: 1) Can I leave the organization without paying penalty fees to pursue a better job opportunity, considering this is my first job and I wish to avoid legal complications for future employments? 2) Is it legally valid for the employer to charge a Training Fee of Rs. 50,000, especially considering the limited nature of the training provided internally? 3) If I leave before the completion of probation and training periods, will I still be obligated to pay the full Training Fee? 4) If I don't disclose the actual reason for resignation and state a medical condition instead, can the company later charge me with notice or other penalties? 5) Can I opt not to serve the notice period, given that I have been with the company for only two months?
